1. How do I have the flag removed?

If there was no flagging error, you must:

• Pay the total amount due on all citations and pay the MVA administrative flag fee.
• Obtain a VR119 flag release form (“Traffic Control/Parking Fine Receipt”) from the Walk in payment center at 4040 Blackburn Lane, Burtonsville, MD 20866
• Provide to MVA a copy of the VR119 form, which informs them to release the registration flag

The citizen may have to pay an additional $30.00 re-instatement fee to MVA upon receipt of their new registration.

There is a weekly process whereby any citations that are paid to the City of Hyattsville that are currently on hold with MVA will be automatically submitted for a VR-119 electronically. The VR-119 form process described above is only in the case where the flag release is needed the same day as payment is made.

2. I was flagged in error. Will I still have to pay the flag fee and re-instatement fee?

If the citation or flag fee was a result of program error, the citizen does not have to pay the Flag fee or re-instatement fee.

3. I have sufficient proof and/or documentation to prove the citation was issued in error. Can I just mail the proof in?

Reasons that the citation was issued in error include the following:

• Stolen tags or vehicle (police report required)
• Vehicle mismatch with registration identification
• On government business

Yes, all documentation supporting the claim should be mailed or faxed to allow for review. Once the documentation is received, it is reviewed for all pertinent information.

On Government Business - City of Hyattsville personnel will have to review documentation from agency verifying that they were on government business and make a determination.

4. Stolen Tags or Vehicle: My vehicle or tags were stolen before the citation was issued.

The citizen must submit a copy of the police report or documentation from MVA listing date of cancellation of stolen items.

5. Vehicle mismatch with registration identification: The vehicle described on the citation does not match the registration I have for the corresponding tag number.

The citizen must send a copy of his/her registration and/or other supporting documentation with a copy of the citation to the City of Hyattsville Safe Speed P.O. Box 1877, MD 21203.

If there are no matches to the described vehicle on the citation in the MVA files, the citation will be dismissed. If there is a match, the citizen will be notified of the match and responsibility of payment.

6. I loaned my car to someone else. Why am I responsible for the citation?

Liability for citations ultimately rests with the registered owner.

The registered owner has the right to identify the person who was in care, custody or control of the vehicle at the time of the speeding violation. The registered owner must provide:

• A sworn written statement sent certified mail / Return Receipt Requested
• The citation number
• Any other corroborating evidence, which may include the name, address, and driver’s license number of the person driving the vehicle at the time of the violation.

NOTE: If the identified driver does not satisfy the ticket, the registered owner is still ultimately responsible. The registered owner will be subject to further action to include vehicle registration flagging and collections.

7. I was driving a rental vehicle at the time of the violation. Why am I receiving this notice?

These citations should be automatically rejected during the review process due to the state law’s exemption of rental vehicles from automated speed citations. Some rental companies may not be recognizable by reviewers.

If it is determined that a rental company vehicle received a citation then that citation should be forwarded to the Hyattsville PD to approve the void of the citation.

8. I was driving a leased vehicle at the time of the violation. Why am I receiving this notice?

All leased vehicles are cited during the review process as it is not possible to determine the length of the lease from the MVA name & address search run for this program. If your lease is 6 months or longer, you are responsible for the citation. If proof is provided that the lease agreement is for a term shorter than 6 months then the citation will be forwarded to the Hyattsville Police Department to approve the void of the citation.

9. Why was I issued this citation?

The citation was issued because your vehicle was captured exceeding the posted speed limit by 12 miles or more in a school zone.
